CastLab Terms of Service

These Terms of Service (the "Terms") are a legally binding agreement between you and River Intel LLC, a Washington limited liability company doing business as CastLab ("CastLab," "we," "us," or "our").

By accessing or using CastLab's websites, web application, mobile applications, and related services (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.

2. Scope of the Services

CastLab provides:

  • Marketplace Services enabling users to purchase remote fly-casting video and/or sensor-based analysis and feedback from independent instructors ("Instructor Services").
  • Digital Content such as instructional video courses and materials offered through the Services ("Digital Content").
  • Platform Tools including session upload, messaging, discovery, and administrative tooling.

CastLab is a technology platform. Instructors are independent contractors and are not employees, agents, partners, or joint venturers of CastLab.


3. Eligibility

The Services are intended for users who are at least 18 years old. By using the Services, you represent and warrant that you are 18+ and have legal capacity to enter into these Terms.


4. Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated by reference.

5. Accounts and Security

You may need to create an account to use certain features. You agree to:

  • provide accurate, current, and complete information;
  • maintain the security of your login credentials; and
  • be responsible for all activity under your account.

You must promptly notify us of unauthorized access or suspected security issues.


6. Purchases, Payments, and Billing

6.1 Payment Methods and Processors

We use third-party payment processors (e.g., Stripe) and may use additional providers. Your purchases may be subject to the processor's terms and policies.

6.2 Web vs. Mobile Purchases

  • Instructor Services (professional consulting / video analysis): purchased via Stripe (including on mobile where offered).
  • Digital Content: may be purchased via Stripe on web and via Apple In-App Purchase / Google Play Billing on mobile.

If you purchase through Apple or Google, the transaction is also governed by their terms. Refunds for Apple/Google purchases are generally handled through Apple/Google, except where required by law.

6.3 Taxes

You are responsible for applicable taxes, duties, and charges unless we are required to collect them.

6.4 Pricing Changes and Errors

We may change prices, offerings, or availability at any time. We may correct pricing errors and may cancel and refund orders affected by such errors.


7. Refunds and Satisfaction Policy

7.1 Instructor Services

(a) Full refund before review starts. If the instructor has not started reviewing your submission, you may request a full refund.

(b) Partial refund after review starts. If the instructor has started reviewing your submission, you may request a partial refund, which we will determine in our reasonable discretion based on work performed and any applicable processor fees.

(c) After delivery. Once feedback is delivered, refunds are generally not available except for duplicate charges, fraud/unauthorized payment, or platform failure that prevented delivery or access.

"Started" may be determined by objective platform signals (e.g., the request is claimed/marked in progress, or feedback artifacts are created).

7.2 Satisfaction Remedy (Not a Blanket Money-Back Guarantee)

If you believe feedback is materially incomplete or clearly mismatched to your submission (e.g., wrong session reviewed), contact support. As a remedy, we may offer, at our discretion:

  • a redo by the same instructor,
  • reassignment to another instructor, and/or
  • a partial refund.

7.3 Digital Content

Digital Content purchases are typically final once access is granted, except where required by law or where the purchase platform (Apple/Google/Stripe) permits refunds.


8. Vouchers and Promotions

We may offer voucher codes or promotional credits subject to additional terms (limits, eligibility, expiration, revocation, non-transferability). We may refuse or revoke vouchers if we reasonably believe they were obtained or used improperly.


9. User Content (Videos, Sensor Data, Notes)

9.1 Your Ownership

You retain ownership of content you upload or submit through the Services (including videos, sensor data, images, text, and notes) ("User Content").

9.2 License to Operate the Services

You grant CastLab a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and share your User Content:

  • with the instructor(s) you select (or are matched with) for Instructor Services;
  • with service providers who help us deliver the Services (e.g., video processing/hosting, storage), subject to reasonable confidentiality and security protections; and
  • as otherwise necessary to operate, maintain, and enforce the Services and these Terms.

This license lasts only as long as reasonably necessary for these purposes, including recordkeeping, dispute resolution, and legal compliance.

9.3 Opt-In Model Training / Research

CastLab may offer an explicit opt-in program that allows certain User Content to be used for model training, evaluation, or research ("Training Use"). Training Use will be disabled by default and presented as a clear opt-in choice. You may revoke participation going forward, subject to technical and legal constraints (e.g., already-completed training runs).

If you do not opt in, your User Content will not be used for Training Use other than standard operational processing necessary to provide the Services.


10. Instructor Services and Instructor Independence

10.1 Independent Contractors

Instructors providing Instructor Services are independent contractors. CastLab does not control how instructors perform their work and does not guarantee outcomes.

10.2 No Medical Advice

CastLab and instructors do not provide medical, physical therapy, or healthcare services. Use appropriate safety practices. Consult a qualified professional for medical concerns.


11. Digital Content License (Your Use)

Unless explicitly stated otherwise, Digital Content is licensed, not sold. You may access and use Digital Content you purchase for personal, non-commercial use only. You may not copy, redistribute, resell, publicly perform, share credentials, or otherwise exploit Digital Content except as permitted by law or with our written permission.


12. Prohibited Conduct

You agree not to:

  • violate laws or regulations;
  • impersonate others or misrepresent affiliation;
  • attempt unauthorized access to systems or accounts;
  • scrape, harvest, reverse engineer, or interfere with the Services (except where prohibited by law);
  • upload malware or disruptive code;
  • upload content you do not have rights to share;
  • harass, abuse, or threaten others; or
  • use the Services to compete with CastLab or build a substitute product.

We may investigate and take action, including suspension or termination.


13. Intellectual Property

The Services (excluding User Content and certain instructor-created materials) are owned by CastLab or its licensors and protected by intellectual property laws. You receive only the limited rights expressly granted in these Terms.

CastLab and related logos/marks are trademarks of River Intel LLC or licensors.


14. Third-Party Services

The Services may integrate or rely on third-party services (payment processors, hosting, video processing/streaming, analytics). CastLab is not responsible for third-party outages or acts outside our control. Your use of third-party services may be governed by their terms.


15. Termination

You may stop using the Services at any time. We may suspend or terminate your account or access if we reasonably believe you violated these Terms, created risk, or engaged in fraud or misuse.

Provisions that should survive termination will survive (including IP, disclaimers, limitation of liability, indemnity, and dispute resolution).


16. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTLAB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CASTLAB DOES NOT GUARANTEE THAT INSTRUCTOR SERVICES OR DIGITAL CONTENT WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR OUTCOME.


17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTLAB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTLAB'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

  • (A) the amount you paid to CastLab for the specific Services giving rise to the claim in the 6 months before the event, or
  • (B) $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.


18. Indemnification

You agree to defend, indemnify, and hold harmless CastLab and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms; or
  • your violation of another party's rights.

19. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.


20. Dispute Resolution: Binding Arbitration and Class Action Waiver

20.1 Informal Resolution First

Before filing a claim, you agree to contact us at support@castlab.io and provide a reasonable opportunity to resolve the dispute informally.

20.2 Binding Arbitration

If we cannot resolve a dispute informally, you and CastLab agree that any dispute or claim arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.

The arbitration will be conducted on an individual basis. The arbitrator may award the same relief a court could award, but only to the extent necessary to resolve the individual dispute.

20.3 Class Action Waiver

YOU AND CASTLAB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

20.4 Exceptions

Either party may bring:

  • claims in small claims court (if eligible), and
  • claims seeking injunctive or other equitable relief to stop unauthorized use or abuse of intellectual property or unauthorized access.

20.5 Severability

If the class action waiver is found unenforceable, then the arbitration agreement may be unenforceable as to class claims, but it will still apply to individual claims to the extent permitted by law.


21. Electronic Communications

You consent to receive communications electronically (email, in-app notices). Electronic communications satisfy legal requirements that communications be in writing.


22. Miscellaneous

  • Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Severability: If a provision is unenforceable, the remainder remains in effect.
  • No Waiver: Failure to enforce a provision is not a waiver.
  • Entire Agreement: These Terms and referenced policies form the entire agreement regarding the Services.
  • Headings: Headings are for convenience only and do not affect interpretation.
